These Website Terms and Conditions (“Terms”) govern your access to and use of ndipheleke.co.za and any related pages, features, content, and communications made available by Ndipheleke. By using the website, requesting a quote, or engaging our services, you agree to these Terms.

1) About our services
Ndipheleke provides:
- Funeral transport (within South Africa and, where arranged, cross-border logistics);
- Repatriation logistics and support (subject to documentation, carrier and authority requirements);
- Undertaker support services (operational/logistics support as agreed).
The website provides general information and a way to contact us for enquiries, quotations, and bookings. A booking is only confirmed once accepted by us in writing (including email/WhatsApp confirmation) and any required deposit/payment and documentation have been provided.
2) Who may use this website
You may use the website if you:
- are 18 years or older, or are using it with appropriate authority on behalf of a family/estate/undertaking business;
- have the legal capacity to enter into binding agreements; and
- will use the site lawfully and in line with these Terms.
If you act on behalf of an organisation (e.g., an undertaker), you warrant that you have authority to bind that organisation to these Terms.
3) Quotations, bookings, and service scope
3.1 Quotes
Quotes are provided based on information supplied by you (e.g., collection location, destination, timing, route, special requirements). Unless stated otherwise:
- quotes are estimates and may change if the scope changes or if additional costs arise (e.g., after-hours work, route changes, permits, tolls, carrier fees, documentation changes);
- a quote may be valid for a limited period as specified in the quote.
3.2 Booking acceptance
A booking becomes binding only when:
- we confirm acceptance in writing, and
- you provide required information and documentation, and
- you pay any deposit/advance payment required (if applicable).
3.3 Service limitations
Our services are subject to:
- road, weather, and safety conditions;
- availability of vehicles, staff, and carriers;
- requirements of authorities, airlines/cargo handlers, border posts, mortuaries, hospitals, SAPS, Home Affairs and/or other relevant entities;
- compliance with all applicable legal and documentation requirements.
We may refuse, suspend, or stop services if:
- documentation is incomplete/incorrect;
- instructions are unlawful or unsafe;
- we reasonably believe continuing would pose material risk to people, property, compliance, or dignity of the deceased.
4) Your responsibilities (families and undertakers)
You agree to:
- provide accurate and complete information (names, locations, timelines, authorisations);
- ensure that the person placing the booking has proper authority (next of kin, authorised representative, undertaker);
- supply all required documents timeously (e.g., permits, letters of authority, release forms, IDs of authorised living persons where needed, airline requirements);
- ensure sites are accessible and safe for collection/delivery (reasonable access for vehicle and personnel);
- notify us promptly of changes (time, route, addresses, special requirements).
You are responsible for delays, costs, or losses resulting from inaccurate instructions, lack of authority, or missing/incorrect documents.
5) Fees, payment terms, and additional costs
5.1 Pricing and invoicing
Pricing may include distance, time, staffing, equipment, after-hours requirements, and third-party charges. Unless stated otherwise in writing:
- invoices are payable immediately on receipt or within the payment period stated on the invoice;
- we may require a deposit or payment in advance.
5.2 Additional charges
You may be charged additional costs where applicable, including (non-exhaustive):
- tolls, parking, and route-related charges;
- after-hours, weekend, or public holiday work;
- waiting time beyond a reasonable allowance;
- border/cargo/airline handling fees;
- urgent re-bookings or route changes;
- additional documentation, escorts, or specialised handling.
We will try to communicate material additional costs in advance where reasonably possible.
5.3 Non-payment
If payment is overdue, we may:
- suspend services (including withholding further performance) where lawful and practicable;
- charge interest and/or recovery costs as permitted by law and contract;
- refer the matter for collection or legal action.
6) Cancellations, rescheduling, and refunds
6.1 Cancellations
Cancellations must be submitted in writing (email or WhatsApp acceptable). Depending on timing and costs already incurred, cancellation fees may apply, including:
- committed vehicle/staff time;
- third-party charges already paid or payable (e.g., airline/cargo/permits);
- admin and coordination costs.
6.2 Rescheduling
Rescheduling is subject to availability and may result in additional charges (e.g., re-routing, after-hours work, third-party change fees).
6.3 Refunds
Refunds (if any) are assessed case-by-case and will exclude non-refundable third-party costs and reasonable work already performed.
7) Estimated times and service performance
Any collection/delivery times communicated are estimates. We are not liable for delays caused by factors outside our reasonable control, including:
- traffic, accidents, road closures;
- weather and natural events;
- failures or delays by third parties (airlines, cargo handlers, border posts, authorities, mortuaries);
- documentation issues not caused by us;
- strikes, unrest, or force majeure events.
We will make reasonable efforts to keep you informed of significant delays.
8) Dignity, safety, and conduct
We aim to conduct all services with dignity and respect. You agree that:
- you will not request unlawful handling or transport;
- you will treat our staff respectfully and not engage in abusive, threatening, or unsafe conduct.
We may terminate or suspend service if staff safety is threatened or if instructions are unlawful.
9) Third-party services and cross-border logistics
Repatriation may require third parties and international coordination. Where third parties are involved:
- their terms, schedules, limitations, and requirements may apply;
- we are not responsible for third-party failures where we acted reasonably in selection and coordination;
- you may be required to pay third-party fees directly or reimburse us.
10) Website content, accuracy, and disclaimers
The website is provided for general information. While we try to keep information accurate and current:
- content may be updated without notice;
- nothing on the site constitutes medical, legal, or regulatory advice.

11) Intellectual property

- unlawful or unsafe requests made by you or persons acting on your behalf.
This does not apply to the extent a loss is caused by our proven negligence or unlawful conduct.
16) Force majeure
We are not liable for failure or delay in performing obligations where caused by events beyond our reasonable control, including (without limitation) acts of God, natural disasters, war, riots, civil unrest, strikes, power failures, fuel shortages, government actions, border closures, or carrier shutdowns.

We will try to resolve disputes in good faith through engagement and practical remedies where appropriate. If a dispute cannot be resolved, either party may pursue legal remedies as set out below.

You consent to the jurisdiction of the courts of South Africa for disputes arising from these Terms or your use of the website, subject to any mandatory consumer protections that may apply.
